1. SPONSOR

The No Pong’s Scratch to Win contest (the “Contest”) is sponsored by No Pong Natural Products Ltd., 2345 Yonge Street, Suite 400, Toronto, ON M4P 2E5 (the “Sponsor”). This Contest is not sponsored, endorsed, administered by, or associated with Facebook or Instagram.

2. ELIGIBILITY

This Contest is open to legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry, except employees of the Sponsor, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, any other parties engaged in the development, production, or distribution of Contest materials, and members of their immediate families (spouse, parent, child, sibling) and those living in the same household.

By participating in this Contest, entrants acknowledge compliance with and agree to be bound by these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, at the Sponsor’s sole discretion.

Wholesale and Retailer Orders are Excluded from the competition.

3. CONTEST DATES AND TIMES

The Contest begins on October 1, 2024, at 12:01 a.m. Eastern Time (ET) and ends on October 31, 2024, at 11:59 p.m. ET (the “Contest Period”), after which time no further entries will be accepted.

4. HOW TO ENTER

a) ENTRY OPTION 1: ENTRY WITH PURCHASE

To enter, visit https://www.nopong.ca and place an order for any No Pong product during the Contest Period. Each eligible order will include a scratch card, providing one (1) chance to win. By placing an order and receiving a scratch card, you acknowledge that you have read and agree to be legally bound by these official rules and regulations (the “Rules”). To be eligible, your order must be placed during the Contest Period and be in accordance with these Rules. There is a maximum of ten (10) Option 1 Entries per person, regardless of the number of orders placed.

b) ENTRY OPTION 2: NO PURCHASE NECESSARY

Limit of ten (10) Option 2 Entry per person during the Contest Period. Any person attempting to exceed the maximum number of Option 2 Entries may be disqualified at the Sponsor’s sole discretion. Option 2 Entries may be rejected if they are not fully completed with all required information and submitted and received in accordance with these Rules.

5. CONTEST PRIZES

There are a total of 301 prizes available to be won, consisting of:

(i) Grand Prize: One (1) Grand Prize* with an Approximate Retail Value (ARV) of $5,000 CAD, consisting of a $4,000 CAD Transat Gift Card** and a $1,000 CAD Visa Prepaid Gift Card***.

*This promotion is not a formal partnership with Transat or Visa.

(ii) Minor Prizes: Three hundred (300) Free No Pong Tins, each with an ARV of $10.95 CAD (total ARV of Minor Prizes is $3,285 CAD). Each Minor Prize is a coupon code redeemable for one (1) free 35g tin of No Pong with free shipping to the coupon redeemer.

Prizes must be accepted as awarded and cannot be exchanged for cash or other substitutes, except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize is unavailable.

6. ODDS OF WINNING

The odds of winning a prize depend on the total number of scratch cards distributed and the number of eligible entries received during the Contest Period.

7. SKILL-TESTING QUESTION

Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, a mathematical skill-testing question.

8. WINNER SELECTION AND CONFIRMATION

Grand Prize

The potential Grand Prize winner (“Grand Prize Selected Entrant”) will be determined by possession of a winning scratch card received during the Contest Period. The winning scratch card will contain a unique five-digit code. The Sponsor does not know in advance which order will contain the winning scratch card.

To claim the Grand Prize, the Grand Prize Selected Entrant must notify the Sponsor by contacting us through the means specified on the scratch card (email or telephone) and provide the unique five-digit code for verification against the Sponsor’s records.

Before being declared the winner, the Grand Prize Selected Entrant must:

Correctly answer a mathematical skill-testing question without assistance.
Sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”) within seven (7) days of notification.
Comply with all other Contest Rules, at the sole discretion of the Sponsor.

If the Grand Prize Selected Entrant does not meet the eligibility criteria, fails to provide the required documents within the specified time, or fails to comply with the Contest Rules, they will be disqualified and will not receive the prize.

Minor Prizes

The potential Minor Prize winners (“Minor Prize Selected Entrants”) will be determined by possession of a winning scratch card received during the Contest Period. The winning scratch card will contain a unique six-digit code with a blank seventh digit space. The correct seventh digit is determined by the answer to a mathematical skill-testing question provided on the scratch card.

Complete and correct seven-digit codes can be used in the Coupon Code field on www.nopong.ca to place an order for a no-charge 35g tin of No Pong with free shipping. Coupon codes expire on December 31, 2024.

Disputes Regarding Identity of Entrant

If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the individual associated with the mailing address provided. Each Selected Entrant may be required to provide proof of identity.

9. RELEASE AND INDEMNIFICATION

The Grand Prize winner must sign the Sponsor’s Winner Release to:

Confirm compliance with the Contest Rules.

Agree to accept the prize as awarded.

Release and hold harmless the Released Parties (as defined below) from any liability arising from participation in the Contest or acceptance or use of the prize.

The “Released Parties” include the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, and each of their respective directors, officers, employees, shareholders, successors, partners, licensees, agents, and assigns.

By participating, entrants agree to release and hold harmless the Released Parties from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Contest or receipt or use of any prize
10. OTHER CONDITIONS

Termination or Modification

The Sponsor reserves the right, subject to applicable law, to terminate, modify, or suspend the Contest without prior notice if the Contest is not capable of running as planned.

Publicity and Entrant Information

By participating in the Contest, entrants consent to the collection, use, and disclosure of their personal information for the purposes of administering the Contest and in accordance with the Sponsor’s Privacy Policy. Entrants agree that their name, city, province or territory, likeness, and any statements they may make regarding the prize may be used for promotional purposes in any media without additional compensation or notice, except where prohibited by law.

Privacy

Personal information collected from entrants will be used by the Sponsor for the purpose of administering the Contest and in accordance with applicable privacy laws and the Sponsor’s Privacy Policy, available at https://www.nopong.ca/privacy-policy/

Law

The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. This Contest shall be governed by the laws of the province of Ontario and the federal laws of Canada applicable therein. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Rule Amendments

The Sponsor reserves the right to amend these Contest Rules or to modify, cancel, or suspend this Contest, subject to applicable law. Any amendments will not materially affect the terms and conditions of the Contest.

Intellectual Property

All intellectual property used in connection with the Contest, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans, and representations are owned by the Sponsor. 3. DATES ET HEURES DU CONCOURS

Le Concours commence le 1er octobre 2024 à 12 h 01, heure de l’Est (HE), et se termine le 31 octobre 2024 à 23 h 59 HE (la « Période du Concours »), après quoi aucune autre participation ne sera acceptée.

4. COMMENT PARTICIPER

a) OPTION DE PARTICIPATION 1 : PARTICIPATION AVEC ACHAT

Pour participer, visitez https://www.nopong.ca et passez une commande de n’importe quel produit No Pong pendant la Période du Concours. Chaque commande admissible inclura une carte à gratter, offrant une (1) chance de gagner. En passant une commande et en recevant une carte à gratter, vous reconnaissez avoir lu et acceptez d’être légalement lié par le présent règlement officiel (le « Règlement »). Pour être admissible, votre commande doit être passée pendant la Période du Concours et être conforme au présent Règlement. Il y a un maximum de dix (10) participations Option 1 par personne, quel que soit le nombre de commandes passées.

b) OPTION DE PARTICIPATION 2 : AUCUN ACHAT NÉCESSAIRE

À réception de votre Participation Option 2 valide, le Commanditaire enverra par la poste une (1) carte à gratter à l’adresse postale fournie, aux frais du Commanditaire. Toutes les demandes doivent être oblitérées au plus tard le 31 octobre 2024 pour être admissibles au Concours.

6. CHANCES DE GAGNER

Les chances de gagner un prix dépendent du nombre total de cartes à gratter distribuées et du nombre de participations admissibles reçues pendant la Période du Concours.

7. QUESTION D’HABILETÉ MATHÉMATIQUE

Les Participants Sélectionnés seront tenus, comme condition pour gagner un prix, de répondre correctement, sans aide de quelque nature que ce soit, à une question d’habileté mathématique.

8. SÉLECTION ET CONFIRMATION DES GAGNANTS

Grand Prix

Le potentiel gagnant du Grand Prix (« Participant Sélectionné pour le Grand Prix ») sera déterminé par la possession d’une carte à gratter gagnante reçue pendant la Période du Concours. La carte à gratter gagnante contiendra un code unique de cinq chiffres. Le Commanditaire ne sait pas à l’avance quelle commande contiendra la carte à gratter gagnante.

Pour réclamer le Grand Prix, le Participant Sélectionné pour le Grand Prix doit informer le Commanditaire en nous contactant par les moyens spécifiés sur la carte à gratter (courriel ou téléphone) et fournir le code unique de cinq chiffres pour vérification avec les dossiers du Commanditaire.

Avant d’être déclaré gagnant, le Participant Sélectionné pour le Grand Prix doit :

Répondre correctement à une question d’habileté mathématique sans aide.
Signer et retourner le formulaire de Déclaration d’admissibilité et de Décharge de responsabilité/publicité du Commanditaire (« Décharge du Gagnant ») dans les sept (7) jours suivant la notification.
Se conformer à toutes les autres règles du Concours, à la seule discrétion du Commanditaire.

Si le Participant Sélectionné pour le Grand Prix ne répond pas aux critères d’admissibilité, ne fournit pas les documents requis dans le délai spécifié ou ne se conforme pas aux Règlements du Concours, il sera disqualifié et ne recevra pas le prix.

Prix secondaires

Les potentiels gagnants des Prix secondaires (« Participants Sélectionnés pour les Prix secondaires ») seront déterminés par la possession d’une carte à gratter gagnante reçue pendant la Période du Concours. La carte à gratter gagnante contiendra un code unique de six chiffres avec un septième chiffre manquant. Les codes complets et corrects de sept chiffres peuvent être utilisés dans le champ Code Coupon sur www.nopong.ca pour passer une commande pour une boîte gratuite de 35 g de No Pong avec livraison gratuite. Les codes coupon expirent le 31 décembre 2024.

Litiges concernant l’identité du participant

Si l’identité d’un Participant Sélectionné est contestée, la participation sera réputée avoir été soumise par la personne associée à l’adresse postale fournie. Chaque Participant Sélectionné peut être tenu de fournir une preuve d’identité.

9. DÉCHARGE ET INDEMNISATION

Le gagnant du Grand Prix doit signer la Décharge du Gagnant du Commanditaire pour :

Confirmer le respect du Règlement du Concours.
Accepter le prix tel qu’attribué.
Libérer et tenir indemnes les Parties Libérées (telles que définies ci-dessous) de toute responsabilité découlant de la participation au Concours ou de l’acceptation ou de l’utilisation du prix.

Les « Parties Libérées » incluent le Commanditaire, ses départements et agences, sa société mère, ses sociétés affiliées et liées, ses filiales, franchisés, agences de publicité et de promotion, et chacun de leurs directeurs, dirigeants, employés, actionnaires, successeurs, partenaires, licenciés, agents et ayants droit respectifs.

En participant, les participants acceptent de libérer et de tenir indemnes les Parties Libérées de toute responsabilité pour toute blessure, perte ou dommage de toute nature résultant de ou en relation avec le Concours ou la réception ou l’utilisation de tout prix.

10. AUTRES CONDITIONS

Résiliation ou Modification

Le Commanditaire se réserve le droit, sous réserve des lois applicables, de mettre fin, de modifier ou de suspendre le Concours sans préavis si le Concours n’est pas en mesure de se dérouler comme prévu.

Publicité et Informations sur les Participants

En participant au Concours, les participants consentent à la collecte, à l’utilisation et à la divulgation de leurs renseignements personnels aux fins d’administration du Concours et conformément à la Politique de confidentialité du Commanditaire. Les participants acceptent que leur nom, ville, province ou territoire, image et toute déclaration qu’ils pourraient faire concernant le prix puissent être utilisés à des fins promotionnelles dans tout média sans compensation ou préavis supplémentaire, sauf là où la loi l’interdit.

Confidentialité

Les renseignements personnels collectés auprès des participants seront utilisés par le Commanditaire dans le but d’administrer le Concours et conformément aux lois applicables en matière de protection de la vie privée et à la Politique de confidentialité du Commanditaire, disponible à https://www.nopong.ca/privacy-policy/.

Loi

Le Concours est soumis à toutes les lois et réglementations fédérales, provinciales et municipales applicables. Ce Concours est régi par les lois de la province d’Ontario et les lois fédérales du Canada applicables. Pour les résidents du Québec, tout litige concernant la conduite ou l’organisation d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux (la « Régie ») pour décision. Tout litige concernant l’attribution d’un prix peut être soumis à la Régie uniquement dans le but d’aider les parties à parvenir à un règlement.

Modification des Règles

Le Commanditaire se réserve le droit de modifier le présent Règlement du Concours ou de modifier, annuler ou suspendre ce Concours, sous réserve des lois applicables. Toute modification n’affectera pas de manière significative les termes et conditions du Concours.

Propriété Intellectuelle

Toute propriété intellectuelle utilisée en relation avec le Concours, y compris, mais sans s’y limiter, les marques de commerce, noms commerciaux, logos, designs, matériel promotionnel, pages web, codes sources, dessins, illustrations, slogans et représentations, est la propriété du Commanditaire. Tous droits réservés. L’utilisation non autorisée est interdite.
